TERMS & CONDITIONS

Maison de La Palingenèse
Effective Date: 01 September 2026

Welcome to Maison de La Palingenèse. These Terms & Conditions govern your use of our website and your purchase of or participation in any services, collections, commissions, or couture experiences offered by Maison de La Palingenèse.

By accessing our website, submitting an inquiry, reserving a silhouette, placing an order, submitting a deposit, or otherwise engaging our services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

If you do not agree to these Terms & Conditions, please do not use this website or engage Maison de La Palingenèse for services.

1. ABOUT MAISON DE LA PALINGENÈSE

Maison de La Palingenèse is a bridal couture house specializing in thoughtfully designed, limited, and bespoke bridal garments. The Maison may offer ready-to-wear, limited-edition, made-to-order, bespoke, and other couture services. Because our garments may be individually constructed and may incorporate unique, vintage, reclaimed, deadstock, or otherwise pre-existing textiles and materials, no two garments are necessarily identical. The Maison reserves the right to determine which services, silhouettes, materials, and commissions it accepts.

2. CLIENT ELIGIBILITY

By engaging Maison de La Palingenèse, you represent that you are legally capable of entering into a binding agreement. Clients are responsible for providing accurate and complete information necessary for the fulfillment of their commission, including contact information, measurements, preferences, event dates, shipping information, and other requested details. The Maison is not responsible for delays, additional costs, or errors resulting from inaccurate, incomplete, or outdated information provided by the client.

3. COUTURE COMMISSIONS

A bespoke commission begins only after the Maison has accepted the commission and the required deposit has been received. Each commission is developed according to the selected silhouette, the client's approved design direction, measurements, preferences, and the availability of appropriate materials. The Maison reserves the right to decline a commission at its discretion. Once production has begun, the design may not be materially changed at the client's request without written approval from the Maison. Any approved change may result in additional costs, material charges, alterations, or changes to the anticipated completion date.

4. BOOKING REQUIREMENT

Bridal couture commissions must generally be reserved at least twelve (12) months before the client's wedding date. The Maison may accept commissions with less than twelve months' notice at its discretion and subject to production capacity. Rush commissions may be subject to additional fees and are not guaranteed. A wedding date does not constitute a confirmed commission until the Maison has accepted the commission and the required deposit has been received. Clients are encouraged to begin the consultation and commissioning process as early as possible.

5. INVESTMENT & DEPOSIT

The standard deposit for a bespoke silhouette is fifty percent (50%) of the total investment for the selected design. The deposit secures the client's commission and allows the Maison to begin the design, sourcing, preparation, and production process. All deposits are non-refundable. Payment of the deposit constitutes the client's agreement to these Terms & Conditions. The remaining balance is due according to the payment schedule established by the Maison at the time of commissioning and must be paid in full before the completed garment is released to the client or shipped. The Maison is not obligated to release, ship, or transfer ownership of a completed garment until all amounts due have been paid in full.

6. CANCELLATIONS

Because bespoke garments are created specifically for an individual client, cancellations are subject to strict limitations. If a client cancels a bespoke commission after the deposit has been submitted, the deposit is forfeited. If production has begun, the client may also be responsible for the cost of textiles, materials, specialty components, labor, or other expenses acquired or incurred specifically for the commission, to the extent permitted by applicable law. Cancellation does not automatically relieve the client of financial obligations already incurred in connection with the commission. The Maison will communicate any additional balance owed to the client following cancellation.

7. DESIGN CHANGES AFTER PRODUCTION BEGINS

Bespoke commissions are developed collaboratively before production begins. Once production has begun, a client may not unilaterally change the approved design. If a client requests a material change after production begins, the Maison will determine whether the requested change is technically and practically possible. If the Maison agrees to the change, the client may be responsible for additional design, labor, alteration, textile, material, and production costs. If the requested change requires abandonment or substantial alteration of the existing design, the client forfeits the original deposit and remains responsible for textiles and materials acquired for the commission.

8. TEXTILES & MATERIALS

Maison de La Palingenèse may work with new, vintage, deadstock, reclaimed, thrifted, antique, heirloom, or otherwise pre-existing textiles and materials. Such materials may naturally contain variations in color, texture, weave, age, wear, markings, irregularities, fading, or other characteristics consistent with their history. These characteristics are not necessarily considered defects and may contribute to the individual character of the garment. Because certain materials may be limited, discontinued, vintage, reclaimed, or otherwise unavailable in sufficient quantities, exact replication of a material, trim, color, or textile may not always be possible. If the Maison determines that a material originally contemplated for a commission is unavailable, unsuitable, unsafe, or otherwise impractical for production, the Maison will discuss an appropriate substitute with the client before proceeding with the substitution.

9. MEASUREMENTS & FIT

Bespoke garments are constructed according to measurements and design information provided or confirmed during the couture process. Clients are responsible for providing accurate information and attending required fittings. Changes to the client's body measurements after construction has begun may affect the fit of the garment and may result in additional alteration costs. The Maison cannot guarantee a particular fit if the client does not provide accurate measurements, does not attend required fittings, or experiences substantial body changes after measurements have been taken.

10. FITTINGS

The bespoke couture experience includes two (2) fittings. The purpose of the fittings is to assess and refine the fit and construction of the garment within the scope of the approved design. Additional fittings requested by the client or required because of circumstances outside the Maison's control may be subject to additional fees. The client is responsible for attending scheduled fittings and communicating any concerns regarding fit or construction promptly.

11. ALTERATIONS

All alteration requests for event dates less than 14 days away are subject to a rush fee, which must be paid in full before any work can begin.

The two-fittings for the bespoke experience are limited to adjustments reasonably necessary to achieve the intended fit of the approved design. Alterations requested beyond the included fittings are the financial responsibility of the client. Additional alterations may include, but are not limited to, changes resulting from body measurement changes, styling changes, client-requested modifications, changes to the original design, or alterations requested after completion. Additional alteration work will be discussed with the client before being performed whenever reasonably possible.

For evening gown alterations, the client acknowledges that any changes in body measurements or weight after the first fitting that require additional alterations will incur extra service charges, and The Maison is not responsible for fit issues resulting from such fluctuations.

12. WEDDING POSTPONEMENTS

A postponement, rescheduling, or change of wedding date does not automatically cancel or terminate a bespoke commission. Because production, materials, labor, and scheduling are committed specifically to the client's commission, the client remains responsible for fulfilling the financial obligations associated with the commission, including the remaining balance. The Maison will make reasonable efforts to accommodate a new wedding date, when possible, subject to production schedules and availability. A postponement may require adjustments to fittings, delivery, storage, alterations, or other services and may result in additional costs.

13. FINAL SALE

All alterations and custom fitting services are strictly final sale. No refunds or partial refunds will be granted once work begins. By accepting and collecting the gown from The Maison, the client acknowledges complete satisfaction and waives all rights to future claims or structural changes.

Bespoke gowns are final sale. Because bespoke garments are individually constructed according to the client's measurements, preferences, and approved design, they cannot be returned, exchanged, or refunded. Once a bespoke commission has entered production, the client acknowledges that the garment is being created specifically for them and agrees to the final-sale nature of the commission. Nothing in these Terms & Conditions limits rights that cannot legally be waived under applicable law.

14. DELIVERY & INTERNATIONAL SHIPPING

Maison de La Palingenèse may ship garments domestically and internationally. The client is responsible for providing an accurate delivery address and any requested shipping information. International clients are responsible for applicable customs duties, import taxes, brokerage fees, tariffs, or other charges imposed by the destination country unless otherwise expressly stated by the Maison. Delivery dates are estimates unless a specific delivery date has been expressly agreed to in writing. The Maison is not responsible for delays caused by customs, carriers, weather, governmental authorities, international shipping restrictions, or circumstances beyond the Maison's reasonable control. Clients are responsible for reviewing international shipping requirements applicable to their destination.

15. RECEIPT & INSPECTION

Clients should inspect their garment promptly upon receipt. Any concern regarding damage or an apparent production issue should be communicated to the Maison as soon as reasonably possible and, where practicable, within seven (7) days of delivery. Clients should retain original packaging and shipping documentation when reporting shipping-related damage. This provision does not limit any rights or remedies that cannot legally be excluded under applicable law.

16. INTELLECTUAL PROPERTY

All original designs, sketches, patterns, illustrations, photographs, written content, logos, trademarks, concepts, collection names, silhouettes, and other intellectual property created or owned by Maison de La Palingenèse remain the property of the Maison unless expressly transferred in writing. Purchasing a garment does not transfer ownership of the underlying design, pattern, concept, or intellectual property to the client. Clients may not reproduce, manufacture, commercially exploit, copy, distribute, or authorize reproduction of Maison designs without the Maison's prior written permission.

17. CLIENT CONFIDENTIALITY & PRIVACY

Maison de La Palingenèse respects the privacy and confidentiality of its clients. Information shared by clients in connection with a private consultation will be treated as confidential, except where disclosure is required by law or reasonably necessary to fulfill the commission. The Maison will not intentionally disclose private client information to third parties for purposes unrelated to the client's commission without appropriate authorization.

Client names, wedding details, measurements, personal communications, and other private information may be treated as confidential information. The Maison may maintain records necessary for business operations, accounting, legal compliance, order fulfillment, and client service.

18. PHOTOGRAPHY & USE OF COMPLETED WORK

Maison de La Palingenèse may photograph garments, details, textiles, fittings, and completed commissions for archival, editorial, portfolio, educational, marketing, or promotional purposes. Because bespoke bridal commissions may involve private clients and private events, the Maison will not intentionally publish identifiable client information, wedding details, or images of a client without appropriate permission. Clients may communicate any reasonable privacy restrictions to the Maison before or during the commissioning process. Specific photography or publicity arrangements may be established separately in writing.

19. WEBSITE CONTENT

All content appearing on the Maison de La Palingenèse website, including text, photographs, graphics, logos, designs, collection names, videos, and other materials is owned by or licensed to the Maison unless otherwise indicated.

Website content is provided for informational and promotional purposes and may change without notice.

The Maison makes reasonable efforts to present colors, textures, and materials accurately; however, differences may occur depending on the client's device, display settings, photography, lighting, and the natural characteristics of individual textiles.

20. THIRD-PARTY SERVICES

Maison de La Palingenèse may use third-party providers for services such as payment processing, website hosting, shipping, communications, scheduling, and other business operations.

Third-party services may be subject to their own terms, conditions, and privacy policies.

The Maison is not responsible for the independent policies or practices of third-party providers beyond the Maison's reasonable control.

21. FORCE MAJEURE

The Maison will not be liable for delays or inability to perform caused by circumstances beyond its reasonable control, including but not limited to natural disasters, fire, flood, severe weather, governmental action, transportation disruption, labor disruption, supply-chain interruption, illness, material shortages, war, civil unrest, or other extraordinary circumstances.

When reasonably possible, the Maison will communicate significant delays to affected clients and work toward an appropriate solution.

22. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, Maison de La Palingenèse provides its website and services without warranties beyond those expressly provided in writing.

The Maison does not guarantee that the website will always be uninterrupted, error-free, or available.

Nothing in these Terms & Conditions excludes warranties or consumer protections that cannot legally be excluded under applicable law.

23. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Maison de La Palingenèse and its owners, officers, employees, contractors, agents, affiliates, and service providers shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the website or services.

Nothing in these Terms & Conditions shall limit liability that cannot legally be limited or excluded under applicable law.

24. INDEMNIFICATION

To the fullest extent permitted by applicable law, the client agrees to indemnify and hold harmless Maison de La Palingenèse, its owners, officers, employees, contractors, agents, affiliates, and service providers from claims, damages, liabilities, costs, and expenses arising from the client's breach of these Terms & Conditions, unlawful conduct, or misuse of the Maison's website, designs, or services.

25. SEVERABILITY

If any provision of these Terms & Conditions is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

26. WAIVER

The failure of Maison de La Palingenèse to enforce any provision of these Terms & Conditions shall not constitute a waiver of that provision or of the Maison's right to enforce it in the future.

27. GOVERNING LAW

These Terms & Conditions and any separate agreement through which Maison de La Palingenèse provides services shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to conflict-of-law principles.

Any dispute-resolution or venue provisions should be interpreted and applied consistent with applicable Louisiana law.

28. CHANGES TO THESE TERMS

Maison de La Palingenèse reserves the right to update or modify these Terms & Conditions from time to time. The most current version will be published on this website with its effective date.

Changes will apply prospectively unless otherwise required by applicable law or expressly agreed to in writing. Continued use of the website following publication of updated Terms & Conditions constitutes acceptance of the updated terms.

For existing couture commissions, the Terms & Conditions in effect when the commission was accepted will generally govern that commission unless otherwise agreed in writing or required by applicable law.

29. ENTIRE AGREEMENT

These Terms & Conditions, together with any written commission agreement, invoice, approved proposal, payment schedule, or other written agreement issued by Maison de La Palingenèse, constitute the agreement governing the applicable client relationship.

If there is a conflict between these Terms & Conditions and a separately executed written commission agreement, the separately executed agreement will control to the extent of the conflict.
